The Federal High Court sitting in Abuja on Monday shifted the multi-billion naira asset forfeiture suit brought by the Economic and Financial Crimes Commission (EFCC) against the former Minister of State for Petroleum Resources, Chief Timipre Sylva, to July 16, 2026.
The presiding judge, Justice Obiora Egwuatu, announced the new date during a scheduled progress hearing. The session was primarily dedicated to evaluating the anti-graft agency’s compliance with previous judicial mandates concerning the temporary seizure of nine luxury real estate assets linked to the former minister across elite districts in the Federal Capital Territory (FCT).
The Publication Window and Procedural Compliance
The legal battle, marked as Suit No: FHC/ABJ/CS/607/2026, was initiated by the anti-graft commission under the strict asset preservation provisions of the Advance Fee Fraud and Other Related Offences Act, 2006. On April 24, 2026, the court had granted an ex parte application moved by EFCC counsel, Oluwaleke Atolagbe, ordering an interim forfeiture of the properties based on a prima facie case that they represent proceeds of unlawful activities, specifically the dishonest conversion of public funds totaling approximately $14.8 million (N11.59 billion).
At the resumption of proceedings on Monday, which had been explicitly earmarked for a “compliance report,” the court verified that the commission had executed its directive to publish the interim forfeiture order in major national newspapers, including The Guardian and Premium Times.
This publication serves as a statutory 14-day public window inviting any individual, corporate entity, or third-party claimant with a legitimate interest in the listed assets to appear before the court. Such persons must show cause why a final, permanent forfeiture order should not be made in favor of the Federal Government of Nigeria.
With the publication phase verified and responses trickling into the judicial registry, Justice Egwuatu ruled that the case was now ripe for a full, substantive hearing on the motion for final forfeiture. To allow both the prosecution and defense teams adequate time to fully regularize their processes and submit their comprehensive briefs of argument, the court adjourned the matter to July 16.
