The high-stakes legal battle involving embattled former CBN Governor Godwin Emefiele took a dramatic turn at the Ikeja Special Offences Court on Monday. In a packed courtroom, Justice Rahman Oshodi ruled that statements made by Emefiele’s associate and co-defendant, Henry Omoile, are legally admissible, dealing a blow to the defense’s attempt to have them suppressed.
The air in the courtroom was thick with anticipation as the judge delivered his ruling on the “mini-trial” that has stalled the main proceedings for weeks. Mr. Omoile had alleged that EFCC operatives used “inducement and threats” to squeeze information out of him during his detention. But Justice Oshodi wasn’t buying it.
“The prosecution has proven beyond reasonable doubt that the statement was made voluntarily,” the judge declared. He pointed out that there was no evidence of physical harm and that the interrogation environment appeared standard. This means the EFCC can now use Omoile’s own words from February 26, 2024, against him and, potentially, to bolster the case against the former “Number One Banker.”
It wasn’t a total loss for the defense team, led by Labi Lawal, SAN. The judge threw out a second statement made on February 27 because it wasn’t recorded on video and no lawyer was present—a strict requirement under Lagos State’s tough criminal justice laws.
Emefiele, who looked on as the ruling was read, is fighting 19 counts of corruption and abuse of office. Omoile is accused of acting as a middleman for illegal gifts. With the legal technicalities of the “trial-within-trial” now largely settled, the court has cleared its calendar for a marathon of hearings starting June 26. For Lagosians and the wider Nigerian public, the wait for a verdict in one of the decade’s biggest corruption scandals continues.
